    1. Agreement to Terms

    By accessing or using Pet Decoder AI ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

    The Service is operated by Pet Decoder AI Inc., a company incorporated in Ontario, Canada, located at 2967 Dundas St W #287, Toronto ON M6P 1Z2, Canada.

    2. Description of Service

    Pet Decoder AI provides AI-powered pet behavior analysis services. Users can upload photos and videos of their pets to receive analysis of their pet's mood, body language, and behavioral insights.

    Important: The Service is intended for informational and entertainment purposes only. It is NOT a substitute for professional veterinary care, medical diagnosis, or treatment.

    3. User Accounts

    To use certain features of the Service, you must:

    • Create an account with accurate, current, and complete information
    • Be at least 16 years of age (or the age of majority in your jurisdiction)
    • Maintain the security and confidentiality of your account credentials
    • Notify us immediately of any unauthorized access or use of your account
    • Accept responsibility for all activities that occur under your account
    • Not share your account with others or create multiple accounts

    4. Acceptable Use

    You agree NOT to:

    • Upload content that is illegal, harmful, threatening, abusive, defamatory, or offensive
    • Upload images or videos that you do not have the right to use
    • Upload content depicting animal abuse or cruelty
    • Use the Service for any unlawful purpose or in violation of any laws
    • Attempt to gain unauthorized access to our systems or other users' accounts
    • Interfere with or disrupt the Service or servers
    • Use automated means (bots, scrapers) to access the Service without permission
    • Reverse engineer, decompile, or attempt to extract source code
    • Circumvent any security or access controls
    • Use the Service to harm, exploit, or endanger any animal

    4.1 Prohibited Content & Automated Screening

    Content Moderation: All media uploaded to Pet Decoder AI is automatically screened by our AI systems before analysis. The following content categories are strictly prohibited and will be automatically rejected:

    • Animal Abuse or Cruelty: Any content depicting physical harm, neglect, fighting, or distress caused by human actions toward animals
    • Explicit or Sexual Content: Pornographic, sexually explicit, or obscene material
    • Violence or Gore: Graphic depictions of violence, severe injury, or death
    • Illegal Activities: Content depicting or promoting illegal conduct under Canadian law or the laws of your jurisdiction

    Rejection & Non-Storage: Content flagged by our automated screening systems will be immediately rejected. Rejected content is NOT stored on our servers. However, metadata about the rejection (timestamp, category, user identifier) may be logged for legal compliance, fraud prevention, and to enforce these Terms.

    Zero Tolerance Policy: Any violation of our content policy will result in immediate and permanent termination of your account. Additionally, violations may be reported to law enforcement authorities where required by law or where we reasonably believe illegal activity has occurred.

    Legal Compliance: We may be required to retain certain records and cooperate with law enforcement agencies in accordance with applicable Canadian and international laws, including but not limited to the Criminal Code of Canada and applicable animal protection legislation. We reserve the right to report suspected animal abuse to relevant authorities.

    5. Content Ownership and License

    Your Content

    You retain ownership of all content you upload (photos, videos, pet information). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and analyze your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or account.

    Our Content

    The Service, including its original content, features, functionality, design, and underlying technology, is owned by Pet Decoder AI Inc. and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

    6. Purchases, Credits & Refund Policy

    Credit Purchases

    Pet Decoder AI offers credit packs that allow you to analyze your pet's photos and videos. Credits are purchased through our secure payment processor (Stripe) and are added to your account immediately upon successful payment.

    No Refunds Policy

    All credit purchases are final and non-refundable. Due to the digital nature of our service and the immediate delivery of credits, we do not offer refunds, returns, or exchanges for any purchased credits, regardless of whether they have been used.

    Exceptions

    In exceptional circumstances, such as duplicate charges or technical errors on our part that prevent you from using purchased credits, we may, at our sole discretion, issue a refund or credit adjustment. To request a review, please contact us at support@petdecoder.ai within 7 days of the purchase.

    Account Termination

    If your account is terminated for any reason (whether by you or by us), any unused credits in your account will be forfeited and no refund will be provided.

    7. AI Analysis Disclaimer

    IMPORTANT - PLEASE READ CAREFULLY:

    • AI analysis is generated by automated systems and is for informational and entertainment purposes only
    • Analysis results should NOT be used as a substitute for professional veterinary advice, diagnosis, or treatment
    • We do not guarantee the accuracy, completeness, reliability, or suitability of any analysis
    • The Service cannot diagnose health conditions, diseases, or medical issues
    • Always consult a qualified veterinarian for any concerns about your pet's health or behavior
    • You acknowledge that AI technology has limitations and may produce incorrect or misleading results
    • We are not liable for any decisions or actions you take based on AI analysis results

    8. Disclaimer of Warranties

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

    We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) results obtained from the Service will be accurate or reliable; (c) any errors will be corrected; or (d) the Service will meet your requirements.

    9. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PET DECODER AI INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

    • Any indirect, incidental, special, consequential, or punitive damages
    • Any loss of profits, revenue, data, goodwill, or other intangible losses
    • Any damages resulting from your use or inability to use the Service
    • Any damages resulting from reliance on AI analysis or any content provided
    • Any damages arising from unauthorized access to your data
    • Any damages exceeding the amount you paid us in the past 12 months (or $100 CAD if you have not made any payments)

    10. Indemnification

    You agree to indemnify, defend, and hold harmless Pet Decoder AI Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your content.

    11. Account Termination

    By Us: We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms, suspected fraud, or if required by law.

    By You: You may delete your account at any time through your Dashboard settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

    Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will survive (including ownership, disclaimers, indemnification, and limitations of liability).

    12. Dispute Resolution

    Informal Resolution: Before filing any formal dispute, you agree to contact us at legal@petdecoder.ai to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

    Mediation: If informal resolution fails, either party may submit the dispute to non-binding mediation administered by a mutually agreed mediator in Toronto, Ontario.

    Jurisdiction: If mediation is unsuccessful, any legal action shall be brought in the courts of the Province of Ontario, Canada, and you consent to the exclusive jurisdiction of such courts.

    13. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

    14. Changes to Terms

    We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. For significant changes, we may also notify you via email or an in-app notification. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service and delete your account.

    15. General Provisions

    Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

    Waiver: Our failure to enforce any right or provision shall not be considered a waiver of that right or provision.

    Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.

    Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.

    Third-Party Services: We use third-party services including Google Ads for advertising and conversion tracking. By using our Service, you acknowledge that these third parties may collect data about your usage in accordance with their own privacy policies. Please refer to our Privacy Policy for more details on tracking technologies and your choices.
